Terms of Service

These Terms of Service (“Agreement”) apply to all Website Hosting and Website Maintenance Care Plan services (“Services”) provided by Nerd Free Marketing (“we,” “us,” “our”). By using or continuing to use our Services, you agree to these terms.

1. Services Provided
   We provide website hosting, website maintenance, updates, backups, security monitoring, and related support as described on your invoice or plan description.

2. Billing and Automatic Renewal
   Services are billed monthly or annually according to the plan or special offer you accepted when starting or modifying your Services.

All plans automatically renew at the end of each billing cycle unless cancelled in accordance with this Agreement.
By continuing to use our Services after your renewal date, you agree to the renewal charges and the continuation of your plan under these terms.

Invoices are due immediately upon receipt. We automatically charge the payment method on file on each renewal date. It is your responsibility to keep your payment method current and funded.

3. Cancellation
   You may cancel your Website Hosting or Website Maintenance Care Plan by emailing our support address at least 30 days before your next billing date.

We do not accept cancellations via phone, text, live chat, or social media.

If the required 30-day notice is not provided, you will be responsible for the next billing cycle, and the cancellation will take effect at the end of that paid term.

Nerd Free Marketing does not offer refunds on Website Hosting or Website Maintenance Services.

4. Non-Payment & Service Suspension
   If payment is not received within 10 days of the invoice date, your account is considered in default and may incur interest as outlined on your invoice.

Accounts unpaid after 30 days may be suspended. Suspension does not remove your responsibility to pay the outstanding balance.

If you request reactivation within 30 days of suspension, all outstanding invoices plus a $25 restoration fee must be paid before services resume.

5. Migration Upon Termination
   If you terminate Services, we can assist in migrating your website in one of the following ways:

1. Provide an admin login so your new host can migrate your site

2. Provide a backup using an industry-standard backup tool for $150

3. Perform the migration for you at our current hourly rate
   For security reasons, we do not provide FTP or control panel access.

After termination, all responsibility for backups, updates, security, and hosting falls to you or your new provider.

6. No Refund Policy
   We do not offer refunds for Website Hosting or Website Maintenance Care Plans, regardless of usage, cancellation date, or early termination.

7. Limitation of Liability
   In no event shall Nerd Free Marketing be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount paid by the client for Services during the previous six months.

8. Governing Law
   This Agreement is governed by the laws of the State of Alabama. Any disputes will be handled through mediation in Mobile County, Alabama.

By using our hosting services, you agree to comply with the terms and acceptable use policies of any hosting providers we partner with. These policies may include restrictions on prohibited content, resource usage, and security requirements.
